Our Motorcycle Accident Attorneys in Temple Terrace Look Beyond the Crash Report
Motorcycle cases can take a different turn from other traffic accident claims. A police report may provide a starting point, but it may not tell the full story of how the crash occurred.
We gather photos, video footage, witness statements, vehicle damage records, and other evidence that can help show what happened. We can also review where each vehicle was traveling and what the drivers were doing in the seconds before the crash.
This kind of evidence can help when someone claims the rider was speeding, weaving through traffic, or taking risks just because they were on a motorcycle.
We Respond When an Insurer Unfairly Blames the Rider
Brooks Law Group will build your case around the evidence and respond when an insurer tries to place unfair responsibility on the rider. Our team will also handle calls and negotiations with the insurance companies. That gives you more time to focus on medical treatment and getting back to your daily life.
If the insurer will not agree to a fair settlement, taking the case to trial may be the next step. Our attorneys can prepare the evidence and arguments needed to present your case in court.

Your Damages Can Reflect the Full Cost of a Motorcycle Crash in Temple Terrace
Riders have little physical protection when vehicles hit their motorcycles and force them off the road. These crashes can cause severe injuries, which may include fractures, road rash, burns, head and brain injuries, spinal cord injuries, internal injuries, or damage to the arms and legs.
Some injuries riders suffer heal over time. Others can affect your ability to walk, work, drive, sleep, or handle everyday tasks long after the crash. At Brooks Law Group, our motorcycle injury lawyers in Temple Terrace will document what the accident has cost you and how your injuries affect your life.
Depending on your case, damages may include medical expenses, future medical care, lost pay, reduced earning ability, property damage, pain and suffering, and other accident-related losses.
A Family May Have a Wrongful Death Claim After a Motorcycle Crash
Losing a family member in a motorcycle crash brings a different kind of case. Brooks Law Group is sorry for what your family is facing, and we will approach the legal process with care and respect.
Florida’s wrongful death law allows certain damages based on the circumstances and the family members involved. These may include funeral and burial expenses, lost support and services, lost companionship or parental guidance, and certain emotional losses.
Our Temple Terrace wrongful death lawyers will explain which damages apply to your family and handle the legal work so you do not have to sort through these questions on your own. For a review of your options, call Brooks Law Group today for a free consultation.

Who Can Be Responsible for a Motorcycle Crash in Temple Terrace?
The driver who struck you may be responsible, but a motorcycle accident can involve more than one party. Depending on what caused the crash, our Temple Terrace motorcycle collision lawyers may investigate:
- The owner of the vehicle involved in the crash
- An employer if its employee was working when the collision happened
- A trucking or delivery company responsible for a commercial vehicle
- A repair shop or other business whose faulty work contributed to the crash
- A vehicle or parts manufacturer if a defect played a role
Motorcycle Crashes Can Involve Different Sources of Insurance Coverage
Finding each responsible party can also help identify insurance coverage that may apply to the crash.
Motorcycle insurance works differently from the coverage many Floridians have for passenger vehicles. Florida’s no-fault law defines a “motor vehicle” as a vehicle with four or more wheels, so its Personal Injury Protection (PIP) requirements generally do not apply to motorcycles.
Depending on the circumstances and the policies involved, coverage may be available through the at-fault party’s liability insurance or uninsured/underinsured motorist coverage. Brooks Law Group can review the policies and determine which sources of coverage may apply.

Proving Negligence Connects Someone Else’s Actions to Your Injuries
To hold another person or business responsible for a motorcycle crash, you generally need to show that the other party had a responsibility to act with care, failed to do so, and caused the crash and your resulting losses. For example, a driver may turn left across a motorcycle’s path, follow a rider too closely, or change lanes without checking for a bike.
Brooks Law Group can use physical evidence, records, and witnesses’ statements to show how an unsafe action led to the collision. Florida also uses a modified comparative fault rule under Florida Statutes § 768.81. If an injured person is found partly responsible, that percentage of fault can reduce the damages awarded.
A person found more than 50% at fault generally cannot recover damages in a negligence action. That rule gives insurers another reason to examine a rider’s actions closely. Our attorney team will challenge fault claims that do not match the evidence.

Meeting Florida’s Filing Deadline for a Motorcycle Injury Lawsuit
Under Florida Statutes § 95.11(5)(a), an action based on negligence generally has a two-year filing period. The state also generally provides two years for a wrongful death action under Florida Statutes § 95.11(5)(e).
Different rules can apply in some cases, including claims involving a government agency. Starting the investigation sooner can help preserve evidence from the crash. Brooks Law Group will review the crash date and other facts to determine which deadline applies.
