What should you expect as a truck accident victim?

Are you a truck accident victim? Were recently injured in a collision with a commercial vehicle?

Involvement in accidents is traumatic and confusing, but truck accidents can be horrifying. Experiencing destruction, injuries, or witnessing death is difficult. The scene of an accident is often chaotic, and if you don’t have a plan for the unexpected, you’ll feel lost. Brooks Law Group has worked with countless accident victims through the years, and we’re sharing some key information with you so you’re always prepared.

What should I do first as a truck accident victim?

Truck accidents occur frequently on Florida’s highways. That means you are always at risk of experiencing one of these accidents. You’ll rarely expect it, but having a solid plan will make sure you don’t panic as badly if it happens to you.

Document the accident scene with photos and video if possible!

If you are in an accident with a semi-truck or other commercial vehicle, what should you do?

  1. If you aren’t stopped by the impact, safely operating your vehicle is your priority. Maneuver your car to a safe place to park and, if needed, put on your flashers.
  2. Immediately call 9-1-1 after parking if you are physically able. Report the accident and the location. (This is a legal requirement in Florida for those involved in an accident, even if they’re just a witness!)
  3. Evaluate your own condition. Are you seriously injured? Is anyone in your vehicle injured? Render aid as able, and as needed.
  4. Document the scene with video, pictures, etc. if you can safely exit the vehicle.
  5. Reach out to witnesses on site. Exchange contact information if they are willing. This can be important in the days and weeks ahead.
  6. When emergency services show up on-site, seek aid if you’re injured. Even minor injuries usually require a hospital visit for evaluation.

Finally, call your attorney! They need to be part of your case from this moment forward.

What happens next at the accident scene and beyond?

When the accident scene dissipates, and victims have been taken for medical care, police will take statements from witnesses, gather evidence, and clear the scene before roads are reopened. As a truck accident victim, you are responsible for:

Truthful testimony

Telling “the truth, the whole truth, and nothing but the truth” isn’t just for the courtroom on television. You may be interviewed by police and will need to provide an accurate statement about the accident and the circumstances surrounding it. Note: call your lawyer BEFORE this meeting. You have the right to have them with you for this interview and any future interviews.

Taking care of yourself

During the days, weeks, and even months after your accident, take time for self-care! While your attorney is hard at work handling your case, you need to:

  • receive required medical treatments for your recovery
  • take time for fresh air, sunshine, and moderate exercise if you’re medically cleared. This clears your mind and relieves stress!
  • reach out for mental and emotional support
  • seek out therapists who specialize in the care you need for a full recovery
  • REST! Sleep is so important during the healing process

Confidentiality with both information and evidence

Remember the photos and videos you shot at the scene? They don’t belong on social media or YouTube! These items are confidential evidence. Additionally, you may not discuss the accident publicly or share information about the accident or the case. Confidentiality is key when it comes to a truck accident case.

Choosing an attorney

This step is crucial to your outcome. Look for an attorney who has experience with commercial vehicle accidents or truck accidents.

How do I find an attorney if I’m a truck accident victim?

As a truck accident victim, you’ll provide a statement to the police at the scene. However, after this original statement, you need an attorney to represent you during interviews, phone calls, etc. As your truck accident case progresses, your attorney might ask for:

  • a personal, written statement with your detailed account of the collision
  • all medical records, treatment plans, etc. that are related to your accident and injuries
  • agreement to testify in court if the case goes that far
  • any evidence you collected at the time of the accident (the video, photos, etc. referenced above)
