Our Keystone Truck Accident Attorneys May Identify Multiple Liable Parties
Truck accident cases often lead to claims against several parties that share responsibility. Our Keystone truck accident attorneys have experience identifying negligent parties and pursuing fair compensation from each one. Potentially liable parties in truck crashes can include:
- The truck driver: Drivers may be responsible if they were speeding, distracted, under the influence, or violating federal regulations such as hours-of-service limits meant to prevent fatigue.
- The trucking company: Trucking companies themselves can be held liable for negligent hiring, failing to maintain their vehicles, or pushing drivers to break the rules to meet deadlines. Even without these forms of negligence, employers may bear vicarious liability for their drivers’ negligence.
- Cargo loaders: If improperly loaded or overloaded cargo caused the truck to jackknife, roll over, or lose control, the company or individuals responsible for loading the truck may share blame.
- Vehicle manufacturers: Mechanical defects, such as faulty brakes or tire blowouts, can also contribute to truck accidents. The company that designed or manufactured the defective part may be held accountable.
With multiple parties often involved, truck accident cases can quickly become complicated. We’re experienced in handling these multi-party claims and collecting evidence to hold each responsible party accountable.

Exceeding PIP Coverage in Truck Accidents
In Florida, a no-fault state for auto accidents, Personal Injury Protection (PIP) insurance coverage is required for all drivers. Regardless of which parties cause or contribute to a collision, it provides up to $10,000 in immediate coverage for medical care and lost wages. However, truck accidents are often far too severe for PIP to cover the full extent of injuries and damages. This is where pursuing compensation beyond PIP becomes possible.
Florida’s Serious Injury Threshold
Under Florida law, you can seek financial recovery beyond your PIP limits if your injuries meet the state’s definition of a serious injury, which includes:
- Permanent injury or the loss of a bodily function.
- Significant scarring or disfigurement.
- Death resulting from the accident.
Given the size and force of a standard commercial truck often involved in accidents, victims may suffer life-changing injuries, such as spinal cord injuries, fractures, or internal damage. These types of injuries not only meet the serious injury threshold but also allow for additional claims against the at-fault driver and other liable parties.

Our Attorneys Help You Meet Florida’s Statute of Limitations
After a truck accident in Florida, it’s important to act quickly. According to Florida Statutes § 95.11(5)(a), you typically have two years from the date of the accident to file a personal injury lawsuit. If the accident resulted in your loved one’s death, Florida Statutes § 95.11(5)(e) also sets a two-year time limit for filing a wrongful death lawsuit.
Few accident victims realize that filing an insurance claim or negotiating a settlement does not pause or extend the statute of limitations. If the two-year deadline passes and you have not filed your lawsuit, the court can dismiss your case.
