Florida Veteran’s Benefits Attorney
Your Veteran benefits are supposed to support you and your loved ones. But oftentimes, Veterans in Florida are told they are ineligible beneficiaries. Even worse, when the VA determines they have overpaid you, it can be detrimental to your credit history, employment opportunities, and even your eligibility for security clearance. This aggressive collection action can ruin a Veteran’s quality of life and destroy their family’s financial security. That’s why it’s crucial to consult a Florida Veteran’s Benefits Attorney to safeguard you and your family’s future.
There have been multiple rulings over the last couple of years that have changed how the Veterans Administration is willing to compensate Veterans and their families. This makes it difficult for you to receive the benefits you deserve. However, Florida Veteran’s Benefits Attorneys at Brooks Law Group help Veterans and widows and widowers of Veterans receive VA benefits.
And we can help you!
Changes in Veterans Administration Compensation
On January 11, 2024, a new rule went into effect that allows the VA to adjust, suspend, or pause your disability compensation to prevent overpayment. It can affect Defense Department members, especially those receiving active service pay (active duty personnel). Your payment should resume immediately after the VA receives a DOD notice.
According to the Veterans Affairs Department on April 19, 2019:
“If VA receives notice from DOD or a claim for recommencement of payments within one year from the date of release from active duty or active duty for training, payments, if otherwise in order, will be resumed effective the day following release. Otherwise, payments will be resumed effective one year prior to the date of receipt of a new claim.”
Agency Equity Action Plan
In 2024, the Department of Veterans Affairs (VA) also updated its Agency Equity Action Plan in order to better align it with the whole-of-government equity agenda. Because of President Biden’s executive order to further advance racial equality and support for underserved communities through the federal government, the Biden-Harris administration put this plan into action.
These legislative updates will both positively and negatively impact VA disability claims. How this will affect you will depend on your unique situation. Always consult a lawyer to be certain of your rights.
Disability Evaluation Changes
There are even more disability evaluation changes on the rise for United States Military Veterans. In fact, for the past two years, the VA continues to discuss its plans to revise its disability evaluations for mental health and other conditions, including tinnitus and sleep apnea.
Only time will tell how this will affect you. What we know for certain is that changes like these make it even more important for those applying for Veteran benefits and Veteran beneficiaries to learn their rights and get in touch with legal help immediately. If you or your loved one is a U.S. Veteran, call the office of Brooks Law Group and receive our free consultation.
