Under these, employees have a right to one and a half times their regular rate of pay for all hours worked in excess of 40 hours in a week. The FLSA also establishes strict penalties on companies that violate its provisions. These penalties sometimes amount to as much as double back pay damages for companies acting in violation of the law.

Florida Statute Section 448 guarantees that an employee gets a minimum wage of $7.67 for every hour of work for their employer. If an employer has withheld wages from an employee, they may be entitled to:

  • total past and unpaid wages
  • and liquidated damages equal to their unpaid wages, attorneys’ fees, and costs.
