Most people would read that question and say “no.” However, the answer to this question could be yes based on an accident that occurred on December 5th in Plant City. According to TBO.com, two men were ejected from a vehicle after the vehicle hit a ditch and was overturned in a single vehicle accident.

Johan Guevara, 25, and Antonio Marquez-Felixe were in the vehicle and not wearing seatbelts when the accident occurred. At this time, it is still unknown who was driving the vehicle. If Marquez-Felixe, with only minor injuries, was the driver the family of Guevara could file a wrongful death lawsuit against him and his insurance. Even if Guevara was the driver, Felixe could go after the estate of Guevara for his injuries in a personal injury case. It can go either way depending on the facts.

There are a couple important things to keep in mind here. If you are going to be riding as a passenger in someone else’s vehicle, it is a good idea to find out exactly how much car insurance they have to protect you if you are injured in an accident. Another important thing to remember is to make sure that you are carrying enough insurance for yourself – especially uninsured motorist coverage. This protects you if the at fault party does not have enough insurance.
